GST Exemptions

GST-Exempt Goods and Services

Fresh food, education, healthcare, and agriculture are GST-free in India. Here is what is exempt, how exemptions differ from zero-rating, and who does not need to charge GST.

Introduction

Not everything in India carries GST. Schedule III of the CGST Act 2017 lists supplies that are exempt from GST. These include fresh food sold without packaging, education services, healthcare, and agricultural inputs. The government exempts these items to keep essential goods and services affordable, especially for lower-income households.

The key thing to understand is that exempt supplies do not generate input tax credit. A restaurant buying fresh vegetables (GST-free) cannot claim ITC on that purchase. This differs from zero-rated supplies — exported goods carry 0% GST but the exporter can still claim back ITC on inputs.

Key exemption categories

Fresh food is GST-free

Fresh fruits, fresh vegetables, fresh milk, curd, natural honey, cereals, pulses, and spices sold unpackaged carry no GST. Processed or packaged versions of the same items may attract GST.

Education and healthcare

Formal school and college education services are exempt. Healthcare services provided by registered hospitals and clinics are also GST-free. These exemptions make essential services more affordable.

Agriculture and farming

Agricultural produce sold by a farmer (without processing) is exempt. Agricultural machinery, seeds, and fertilizers also attract no GST in many cases, reducing the cost of farming inputs.

Exempt vs zero-rated — the difference

Exempt supplies (no GST) do not generate ITC for the supplier. Zero-rated supplies (0% GST with ITC) — such as exported goods — allow the exporter to claim back input taxes. This distinction matters for business decisions.

Exempt vs zero-rated supplies

Feature Exempt supply Zero-rated supply
GST rate No GST charged 0% GST charged
Input tax credit available No — ITC cannot be claimed on inputs Yes — ITC on inputs can be claimed or refunded
Examples Fresh milk, bread, education, healthcare Exported goods, international services

Frequently asked questions

What does GST exemption mean?

A GST-exempt supply carries no GST. The supplier does not charge GST on the sale, and the buyer cannot claim input tax credit for GST paid on inputs used to make that supply. Exempt supplies are not the same as zero-rated supplies, which carry 0% GST but allow ITC.

Is fresh fruit GST-free in India?

Yes. Fresh fruits and fresh vegetables sold without packaging are GST-free. Once they are processed, packaged, or branded, GST may apply. For example, fresh apples are GST-free, but apple juice in a tetra pack attracts GST.

Do GST-exempt businesses need to register?

A business making only exempt supplies does not need to register under GST. However, if the business also makes taxable supplies above the ₹40 lakh threshold (or ₹20 lakh for special category states), it must register and charge GST on taxable sales.

Is education GST-free in India?

Formal education provided by an educational institution up to higher secondary level is GST-exempt. However, coaching classes, vocational training, and higher education services may attract GST depending on the structure and scale of the provider.

Where can I find the full list of GST exemptions?

Schedule III of the CGST Act 2017 lists all exempt supplies. CBIC notification No. 12/2017-CT(R) lists the specific services that are exempt. Both are available on cbic.gov.in. The GST Council also publishes exemption notifications at gstcouncil.gov.in.
